Terms of Service

1. Contractual Relationship

By registering an account, purchasing credit packages, subscribing to our service, or accessing our virtual tour creation platform, you explicitly agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use Swildel. We reserve the right to modify these Terms at any time. Your continued use of the application following the posting of modifications constitutes your acceptance of the updated terms.

2. Account Creation and Security

To utilize Swildel, you must create a secure account. You may register using Google OAuth or other authentication protocols we choose to make available. You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@wildsojedpk.com of any unauthorized use or security breach. Wildsoj EDPK will not be liable for any loss or damage arising from your failure to protect your login parameters.

3. Description of Service and Credit System

Swildel is a web-based multimedia utility operated by Wildsoj EDPK. The platform lets users capture four distinct corner or perspective photos using standard mobile phone cameras and upload them to our cloud engine to render seamless 360 panoramas.

Our pricing model operates on a recurring credit framework, structured as follows:

• Credit Definition: One credit corresponds to one single, successfully completed 360 panorama stitch operation.
• Credit Consumption Limits: Credits are only consumed when our cloud stitching engine successfully builds and returns a complete equirectangular panorama. The subsequent use of Swildel features, including virtual tour linking, hotspot creation, link sharing, map embeds, and high-resolution downloads, does not consume your credit balance.
• Credit Expiration: Unused credits from monthly subscription cycles do not roll over to the following month unless specified on your invoice or plan details.

4. Billing, Subscriptions, and Cancellation

If you subscribe to our Creator, Pro, or Business pricing plans, you agree to the billing parameters detailed below:

• Billing Cycles: Subscriptions are billed on a recurring monthly or annual basis, depending on the option selected during registration. Annual billing is processed as a single upfront payment reflecting the discounted yearly rates.
• Payment Processing: All transaction records are managed through secure third-party payment processors. You must provide valid credit card or billing details. By submitting this information, you authorize Wildsoj EDPK to charge your payment method for all subscription fees as they fall due.
• Cancellation Policy: You may cancel your subscription at any time through your profile settings. Cancellation stops future recurring charges, but you will not receive a prorated refund for the remainder of your active billing period. Your access to premium features will continue until the end of your paid cycle.
• Refund Exclusions: Except where mandated by local consumer protection laws, all payments, including upfront annual plan subscriptions, are strictly non-refundable.

5. User Content and Media Ownership

You retain full intellectual property ownership, copyright, and distribution rights for all source photos, processed panoramas, and compiled virtual tours you upload or generate using Swildel. Wildsoj EDPK does not claim any ownership rights over your media. By uploading files to Swildel, you grant Wildsoj EDPK a non-exclusive, worldwide, royalty-free, sub-licensable license to host, transmit, cache, resize, and display your media solely for the purpose of providing, hosting, and optimizing our services for you and your designated viewers.

6. User Obligations and Acceptable Use

You are solely responsible for all images, property layouts, and tours uploaded through your account. You agree not to use the application to process or share any content that:

• Infringes on the intellectual property, copyright, trademark, or privacy rights of any third party.
• Captures individuals or private residential spaces without explicit, legal consent from the residents or property owners.
• Contains sexually explicit, defamatory, abusive, harassing, or otherwise unlawful visual materials.
• Is intended to scam, mislead, or misrepresent property conditions on public real estate listings.

Additionally, you agree not to use automated bots, scrapers, script injections, or bulk reverse-engineering tools to intercept, slow down, or copy our proprietary stitching models and viewer engines.

7. Intellectual Property of Wildsoj EDPK

The Swildel brand, software application, browser-based alignment UI, cloud stitching scripts, layout code, designs, and logo graphics are the exclusive intellectual property of Wildsoj EDPK. You may not duplicate, copy, modify, distribute, or reverse-engineer any portion of our codebase, stylesheets, or visual assets without receiving prior written authorization from our legal department.

8. DMCA Copyright Infringement Policy

If you believe that any public panorama or virtual tour hosted on Swildel servers infringes upon your copyright, you may submit a formal DMCA takedown notice to our designated copyright agent. Your request must contain: a physical or digital signature of the copyright owner, a description of the copyrighted work, the exact URL of the infringing material on our platform, your contact email, and a statement made under penalty of perjury that the information provided is accurate. Takedown notices must be sent directly to copyright@wildsojedpk.com.

9. Termination of Service

We reserve the right to suspend or terminate your Swildel account and remove your hosted panoramas immediately, without prior notice, if you violate any provision of these Terms, engage in systemic service abuse, fail to pay recurring plan fees, or use our tools to process prohibited materials. Upon termination, your right to use our platform and access your hosted virtual tours ceases immediately.

10. Disclaimer of Warranties

The service, including our cloud-based image stitching engine and public tour viewer, is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. Wildsoj EDPK does not guarantee that Swildel will be uninterrupted, error-free, secure, or that our alignment algorithms will produce perfectly stitched panoramas for every room configuration, lighting setup, or camera lens. We are not responsible for any distortion, seams, or resolution anomalies in the rendered output.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Wildsoj EDPK, its directors, employees, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, property listings, sales conversions, or goodwill, arising from your use of or inability to use Swildel. In no event shall our total aggregate liability for all claims exceed the total fees paid by you to Wildsoj EDPK for the Swildel application during the twelve months immediately preceding the event giving rise to the liability.

12. Governing Law and Dispute Resolution

These Terms of Service and any disputes arising out of or related to your use of Swildel shall be governed by and construed in accordance with the laws of the jurisdiction of incorporation of Wildsoj EDPK, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located at our primary corporate headquarters.
